The sending of the on-line booking form confirms your acceptance of the terms and conditions set out below and as may from time to time be changed and shall be binding on all persons stated on the booking form. Your villa rental will be confirmed on receipt of the booking form and deposit, only then will your booking be treated as confirmed. As such, the named person on the booking form will be responsible for the total rental price of the property, as agreed. The remaining balance of this price must be paid 10 weeks prior to travel. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking. In these circumstances your reservation deposit will be forfeited.

The rental period generally comprises of a Saturday to Saturday booking, however we shall endeavour to accommodate wherever possible. The villa will be available from 4pm (local time) on day of arrival, and vacated by 10.30am on day of departure.

You are solely responsible for any damage or breakages that may be caused to the villa or its contents by any members of your party (or any visitors/guests you invite into the villa) during your stay. We require a refundable security/breakage deposit of £250 ($425 US Dollars) that our Villa Manager will take from you via Visa / MasterCard / American Express payment, on your arrival. This deposit will be re-credited to the same credit card within a few days of your departure i.e. once our Villa Manager has checked that all is ‘in order’ at the villa and that there are no breakages, damage or missing items. Our management company will check our villa before your arrival and after your departure, and advise us of any problems. This may include additional cleaning costs for removal of stains etc., arising from spillage and the like. We reserve the right to retain the security deposit (either in full or in part) to cover damage, missing inventory items or non-return of keys. Receipts will be provided for repairs / replacements in the unlikely event that retention of the security deposit arises.

In the event of your party needing to cancel the following conditions will apply: We will require notification of cancellation in writing. Cancellation in the period from booking up until 10 weeks before the vacation/holiday is due to begin i.e. when the full balance is payable, will result in loss of the whole of the booking deposit. Cancellation between 6 and 10 weeks of commencement of the vacation/holiday will incur a cancellation charge of 50% of the total cost of the booking. Cancellation less than 6 weeks before the vacation/holiday is due to commence will incur a cancellation charge of 100% of the total cost of the booking. We strongly advise you to take out insurance to cover any cancellation charges and the normal travel insurance cover in respect of illness, injury etc; at the time of booking.

To comply with State Fire Regulations, under no circumstances must any more than the maximum number of persons identified on the booking form occupy the villa. In order to comply with our Homeowners Association regulations, no form of RVs are allowed to be parked on our driveway or the roads within Orange Tree. The swimming pool is used entirely at your own risk. No diving is allowed and children must be supervised at all times whilst in the pool and spa area. Glasses and crockery are not allowed on the pool and spa deck area at any time. Please use the plastic items provided. Pool security fencing is available to be put into place for parties where young children make up part of the group. It is the responsibility of the adults in the party to ensure this safety feature is utilised. We accept no liability whatsoever for any pool or poolside accidents. Pool heaters are mechanical and whilst every effort is made to ensure they are kept in working order, we cannot accept responsibility for mechanical breakdown. The pool and spa heater controls are not to be tampered with in any way, if a problem arises, please contact our management company who will resolve the issue. If the controls (or padlocked housing) are damaged / interfered with, this will result in full and immediate loss of your security deposit.

As Florida is a tropical state, insects, cockroaches, frogs, snakes etc., are part and parcel of the way of life. Their presence in no way reflects the cleanliness of our villa and is not cause for complaints or compensation. To try and avoid these unwanted visitors we recommend that all doors and window are kept shut at all times and all crumbs and food particles are not left anywhere. Should you have any problems in this respect please call the management company who will in turn send the pest control company out as soon as possible.

Whilst utilities are included, to ensure optimum performance and comfortable conditions in our villa, please do not leave external doors / windows open. If left open, this could result in a malfunction / freezing of the air conditioning unit, whereupon charges may be incurred from your security deposit.

Everyone occupying this property must be listed on the booking form, including small children. This is Florida state law and must be adhered to. The accommodation can not be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. Pets are not allowed and no smoking please. Persons under 21 yrs of age are not acceptable unless accompanied by a parent or responsible adult. The owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.

The owners or their management company shall be allowed access at any reasonable time during your stay, this includes pool maintenance, gardeners etc.

In the unlikely event of a problem arising with the villa during your stay, you must immediately contact our Villa Manager who will seek to resolve the matter at the earliest opportunity. Your satisfaction with our villa is of great importance to us and should you consider that the matter is of a serious nature, we ask you to contact us directly within 14 days of your departure from our villa. However, if the problem has not been reported to our Villa Manager, we cannot accept any responsibility for any issues that may have arisen.

We, nor our Villa Manager, accept any responsibility or liability whatsoever for any loss or damage or alterations to the terms of this booking caused by events beyond our control including, but not restricted to, war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation of schedules by carriers, adverse weather conditions, fire, flood, industrial dispute or any other event beyond our control.

The owners or their management company shall be allowed access at any reasonable time during your stay.

LIABILITY - The villa is privately owned and neither us nor our Villa Manager accept any liability whatsoever for personal injury, accidents, loss or damage to persons or personal effect however caused.

LAW – This contract is subject to, and shall be constructed in accordance with the laws of England and the partied hereto subject to the exclusive jurisdiction of the English Courts.
